Waiver Agreement*

I agree to the Wasatch County Event Complex Yearly Riding Pass Member Waiver

1. Riding passes are not transferable.

2. Riding passes shall be visibly displayed during public riding times.

3. Wasatch County will not be responsible for lost or stolen valuables.

4. I/we personally assume all risk of damages resulting from accidents or injuries sustained while on the premises of the Wasatch County Event Complex

5. All regulations of the Wasatch County event complex will be followed.

6. My pass card will be canceled and riding privileges suspended for allowing anyone else to use it.

7. No Cattle shall be used during open pass riding times.

8. Any obstructions (i.e. barrels, poles. Etc.) Placed in the Arena during riding times, must be removed before leaving the Arena.

9. No horses shall be left unattended in any building or Arena without prior approval from Event Complex Staff.

10. Open pass riding schedule is subject to change without notice.

12. Wasatch County Event Complex reserves the right to ask patrons to leave the premises due to behavior of pass holder or persons affiliated with the pass holder.

13. I agree to clean up after my horse/horses. (I.e. manure, hair, or any other mess that may occur during stay).

I HAVE READ THE ABOVE TERMS AND CONDITIONS AND AGREE TO ABIDE BY THEM DURING THE TERMS OF THIS AGREEMENT AND ANY RENEWALS THEREOF. I/WE AGREE TO THE FOLLOWING CONDITIONS: In consideration and as a condition of being permitted to enter upon, use, and remain upon the premises and facilities of the Wasatch County Event Complex, owned and operated by Wasatch County, and under-designed, acknowledges, confirms, and agrees as follows: For the purpose of the instrument: a. “Equestrian Activity or Event” means any horse related activity or event, or related activity or event conducted or occurring in or about the Wasatch County Event Complex. b. “Related activity or event” includes, but is not limited to, driving, riding, in or upon, boarding or exiting a vehicle or trailer; moving, lifting practicing for engaging or participating in the activity or event. c. “property damage” means damage, destruction, and or incapacitation to any physical property, real property or chattel. d. “Injury” means bodily or other personal injury or death. · The Undersigned applies to Wasatch County for permission to enter upon, use, and remain upon the premises and facilities of the Wasatch County Event Complex for the purpose of engaging or participating in the equestrian activity or event, including any related activities or events. · The undersigned acknowledges and agrees that equestrian (Horse) related activities are inherently dangerous and may result in death or serious injury to a participant. The inherent risks associated with Equestrian activities include, but not limited to, (a) the propensity of the animal to behave in ways that may result in injury, harm, or death to persons on or around them; (b) the unpredictability of the animal’s reaction to outside stimulations such as sounds, sudden movement, an unfamiliar objects, persons, or other animals; (c) collisions with other animals or objects; or (d) the potential animal is not acting within his or her ability. WASATCH COUNTY IS NOT RESPONSIBLE FOR DEATH OR INJURY TO ANY PARTICIPANT IN AN EQUESTRIAN ACTIVITY CASED BY OR ARISING OUT OF THE INHERENT RISKS OF EQUESTRIAN ACTIVITES.” · The undersigned is aware of, and agrees to fully comply with all of the rules and regulations of the Wasatch County Event Complex for the entry, use, and presence of the undersigned upon, on, or within the premises and facilities and engagement and participation in the said event or activity. · Prior to signing this release, waiver of liability, and indemnity agreement, the undersigned has had the opportunity to personally inspect the premises and facilities of the Wasatch County Event Complex and the make inquiries and obtain all relevant and sufficient information and advice, include legal advice, about the nature, risks, and details of above-described activity, event, or related activities or events. · The undersigned acknowledges and confirms that the decision to engage in or participate in the said activity or event and to sign this release waiver of liability, an indemnity agreement is ta voluntary decision and act on the part of the undersigned. · The undersigned here with agrees to release and waive any and every claim for liability with the undersigned by have against Wasatch County and the Wasatch County Events Complexand any of the officers, employees, agents, representatives, and volunteer of the Wasatch County or the Wasatch County event Complex arising from theany injury to the undersigned or any other person or damage to the property of the undersigned or any other person resulting from the entry, use, and presence of the undersigned on, or within the premises of facilities of the Wasatch County Event Complex of from the engagement or participation of the undersigned in said activity or event. · The undersigned herewith agree and promise to Indemnify and hold Wasatch County, the Wasatch County Event Complex and its respective officer, agents, officials and employees, and volunteers harmless and release them for and from any liability, costs or expenses arising from any action, causes of action, claims, for relief, demands, damages, expenses, costs, fees, or compensation, whether or not said actions, causes or action, claims for relief, demands, damages, costs, fees, expenses and/orcompensations are known or unknown , are in law or equity, and without limitation, all claims of relief which can be set forth through a complaint or otherwise that may arise out of the acts or omissions, negligent or otherwise of the undersigned and/or/his/her/their officers, agents, officials, members, employees, and volunteers, or any person or persons. In addition,user agrees to repair, solely at users cost, all damage to Wasatch County’s facilities or equipment arising out or User’s use or possession of said facilities. · This release, waiver of liability, and indemnity agreement constitutes an exculpatory contract between the parties which will deny the undersigned the right to recover damages for Wasatch County Event Complex, and any of the officers, employees, agents, representatives, and volunteers of the Wasatch County of the Wasatch County Event Complex for damages or injury which might occur from the entry, use, and presence of the undersigned on, upon, or within the premises of facilities of the Wasatch County Event Complex or the engagement or participation of the undersigned in the said activity or event. · Permission granted by this agreement for the undersigned to enter upon use and remain upon the premises and facilities of the Wasatch County Event Complex is conveyed solely to the undersigned and said permission may not be transferred, assigned or used by any other person or organization other than the undersigned. Failure to comply with the restriction may result in the revocation of the remission granted under this agreement. · The approval of this instrument and agreement by Wasatch County for itself and on behalf of the Wasatch County Event Complex, and any of the officers employees, agents, representatives, and volunteers of the Wasatch County Event Complex is subject, in part, upon the information provided by the undersigned RELEASE, WAIVEROF LIABILITY, AND INDEMNITY AGREEMENT

I agree to the Rodeo Ticket Waiver

I, the undersigned member (and my parent or guardian if I am younger than 18 years of age), intending to be legally bound, do hereby forever release and waive any and all rights, claims, and actions for damages that we, our heirs, executors, administrators, and assigns may have, or that may hereafter accrue against any and all persons, organizations, and other entities associated with the organization, including, but not limited to Rodeo Ticket, sponsors, affiliates, volunteers, Wasatch County Event Complex Yearly Riding Pass Management, arising out of or in connection with my involvement before, during, or after the association membership.

I verify that I am physically fit and sufficiently capable to participate in this membership and I assume the risks involved in this active membership. I further attest that I will be mindful of risks related to membership, and hold said sponsors and organizers blameless in any harm that may happen.

I consent to the collection and use of my Personal Information as contained in the Privacy Policy. I also give my permission for the free use of my name and/or pictures in telecasts, broadcasts, newspapers, posters, advertising, etc.

I also acknowledge understanding that the charge to my card will show up as Rodeo Ticket. I acknowledge that the online processing fees and charitable donations are non-refundable. I also acknowledge that any charitable donations will have 4.97% withheld from the donation to pay credit card and administrative costs.

Rodeo Ticket shall not be liable to me for any direct, indirect, special, incidental, consequential or exemplary damages including, but not limited to, loss of profits, goodwill, use, data or other intangible loses. Rodeo Ticket does not guarantee the completeness or accuracy of any information contained in, or provided in conjunction with the http://www.rodeoticket.com website. Rodeo Ticket is not responsible for any omissions or inaccuracies, or for the results obtained from this information.

Rodeo Ticket facilitates registration for various events, some of which allow memberships under the age of thirteen (13). We require a submission of birth date for all membership entries. For children under the age of thirteen (13), parental or guardian consent is required.

I agree that the statutes and laws of the State of Utah, USA, will apply to all matters relating to this Agreement and Waiver. I irrevocably consent that exclusive jurisdiction for any dispute with Rodeo Ticket relating to this Agreement and Waiver resides in the courts of Utah, and I further agree and expressly consent to the exercise of personal jurisdiction in the courts of Utah in conjunction with any such dispute including any claim involving Rodeo Ticket.
